Bombay High Court

STATE OF MAHAversusNAGU KESHAV JAGTAP

Disposal
PARTLY ALLOWED AND PARTLY DISMISSED

Holding

The court held that the order must be corrected to insert ‘under section 28 of the Act’ as requested.

Summary

The State of Maharashtra appealed a criminal conviction of Nilkantrao Apparão Patil. During the pendency of the appeal, a motion was filed to correct the minutes of an earlier order dated 24‑08‑2026, specifically to insert the words ‘under section 28 of the Act’ after the term ‘interest’ in paragraph 5 and clause (ii) of the operative part. The respondent’s counsel argued that the omission was a typographical error that needed rectification. Justice Thombre examined the submission and found no substantive prejudice, concluding that the correction was appropriate to reflect the intended reference to section 28. Accordingly, the court ordered that the correction be made, the revised order be uploaded, and any copies issued be deemed corrected. The motion was then disposed of.
