All the first appeals and any pending civil applications were disposed of upon the insurer's withdrawal, allowing claimants to withdraw the deposited compensation.
Summary
The Special Lok Adalat of the Bombay High Court, Aurangabad bench, heard a batch of first appeals filed by New India Assurance Co. Ltd. against various claimants in motor accident claim petitions. The insurer sought condonation of delay in filing the appeals, which the court granted, and then submitted withdrawal letters authorising the withdrawal of all the appeals. The insurer had already accepted the awards of the Motor Accident Claims Tribunals and deposited the compensation amounts with the court registry. The court ordered that claimants could withdraw the deposited compensation with accrued interest and that the appeals, as well as any pending civil applications, be disposed of. It also directed the insurer to inform the claimants of the withdrawal and to process any refund of court fees as per law.
Issues considered
- Whether the court can condone delay in filing the first appeals.
- Whether a party may withdraw pending appeals after acceptance of tribunal awards.
- Effect of withdrawal on the disposition of the appeals and related civil applications.
- Procedural steps for refund of court fees after withdrawal.

- withdrawal of appeal
