The court modified the award, granting compensation at Rs 1.50 per sq ft with statutory benefits and interest, and prohibited any deduction for development cost.

Summary

The appellants, Balaji Vaijanathrao Damkondwar and others, appealed against a judgment and award dated 10 February 2006 by the Civil Judge, Senior Division, Ahmedpur, which refused to enhance compensation for land acquired in 1977. They argued that the compensation should be increased and that no deduction should be made for development costs, invoking benefits under the Land Acquisition Act. The High Court noted a prior decision in First Appeal No. 541 of 2006 (dated 17 March 2022) arising from the same acquisition proceedings and chose to follow that precedent. Accordingly, the court partly allowed the appeals, modifying the award to grant compensation at Rs 1.50 per square foot with statutory benefits and interest, and expressly disallowed any deduction for development cost. The remainder of the original award was confirmed, and the case was remitted to the reference court for implementation.

Issues considered

  • What is the appropriate rate of compensation for land acquired under the 1977 acquisition proceedings?
  • Should statutory benefits and interest under the Land Acquisition Act be awarded to the claimants?
  • Is a deduction for development cost permissible in the compensation award?
  • Should the earlier judgment be modified in light of the precedent set in First Appeal No. 541 of 2006?
