THE STATE OF MAHARASHTRA (THROUGH THE SEPCIAL LAND ACQUISITION OFFICER) AND ANRversusSHRI. RAMA GOPAL TARWARE
- Decided
- Disposal
- Disposed Off
Holding
The first appeal is withdrawn and disposed of as withdrawn.
Summary
The State of Maharashtra, through its Special Land Acquisition Officer, appealed a compensation award granted by the Reference Court. The State relied on three Government Resolutions (dated 3 Nov 2016, 11 May 2018, and 13 Aug 2018) which prescribe that if the enhanced compensation does not exceed four times the original award, the appeal must be withdrawn. The court examined the record and found that the enhanced amount was indeed within the four‑times limit. Accordingly, the court applied the policy decision embodied in the Resolutions and ordered the first appeal to be withdrawn. The court also directed refund of any court fee paid and dismissed any pending interlocutory applications.
