The appeal is withdrawn as the enhanced compensation is within four times the original amount, in accordance with the Government Resolutions.
Summary
The State of Maharashtra, through its Special Land Acquisition Officer, had awarded compensation to the respondent, Eknath Pandu Tarware. The Reference Court enhanced this compensation, but the enhancement did not exceed four times the original award. The State relied on three Government Resolutions (dated 3 November 2016, 11 May 2018, and 13 August 2018) which prescribe that if the enhanced amount is within four times the original, the State's first appeal must be withdrawn. The High Court examined the compensation figures and found the enhancement fell within the stipulated limit. Consequently, the Court permitted the withdrawal of the appeal, ordered a refund of any court fee paid, and dismissed any pending interlocutory applications.
