Bombay High Court
THE STATE OF MAHARASHTRA (THROUGH THE SPECIAL LAND ACQUISITION OFFICER) AND ANR.versusSHRI. MAHADU RAMJI TARWARE
- Decided
- Disposal
- Disposed Off
Holding
The appeal falls within the prescribed policy parameters and is therefore withdrawn.
Summary
The State of Maharashtra, represented by an Additional Government Pleader, relied on three Government Resolutions (dated 3 Nov 2016, 11 May 2018, and 13 Aug 2018) that set a policy for withdrawing first appeals when the compensation enhancement by the Reference Court does not exceed four times the amount awarded by the Special Land Acquisition Officer. The court examined the record and found that the enhanced compensation in the present case was indeed within the four‑times limit. Accordingly, the court held that the appeal fell within the scope of the policy decision. The court therefore permitted the withdrawal of the first appeal and ordered its disposal as withdrawn. It also directed that any court fee paid on the appeal be refunded to the appellant and that all pending interlocutory applications be dismissed.
