The appeal is withdrawn as it falls within the parameters of the Government Resolutions.
Summary
The State of Maharashtra, represented by an Additional Government Pleader, sought to withdraw its first appeal against a compensation award in a land acquisition matter, relying on three Government Resolutions that set a policy for withdrawing appeals when the Reference Court's enhancement does not exceed four times the Special Land Acquisition Officer's award. The court examined the compensation figures and found that the enhancement was indeed within the four‑times limit. Accordingly, the court accepted the State's policy position and ordered the appeal to be withdrawn. The court also directed that any court fee paid be refunded and that all pending interlocutory applications be dismissed. The appeal was thus disposed of as withdrawn.
