The appeal must be withdrawn and disposed of as withdrawn because the enhanced compensation is within the four‑times limit prescribed by the Government Resolutions.
Summary
The State of Maharashtra, represented by the Special Land Acquisition Officer, filed a first appeal challenging the compensation awarded to the respondents. The State relied on three Government Resolutions (dated 3 November 2016, 11 May 2018, and 13 August 2018) which prescribe that if the compensation enhancement by the Reference Court does not exceed four times the original award, the appeal must be withdrawn. The court examined the record and found that the enhanced compensation was indeed within the four‑times limit. Applying the policy decision embodied in the Government Resolutions, the court permitted the withdrawal of the appeal. Consequently, the appeal was disposed of as withdrawn and any court fee paid was ordered to be refunded. All pending interlocutory applications were also dismissed as they did not survive the withdrawal.

the State Government contained in the Government Resolutions
