MR. SIDDHESH VIRESH KULKARNIversusMRS. SNEHAL SIDDHESH KULKARNI NEE SNEHAL ANIL SAMANT

Decided
Disposal
Disposed Off

Holding

The court held that a decree of divorce shall be granted upon the respondent’s receipt of the entire agreed payment consideration as stipulated in the Consent Terms.

Summary

The appellant and respondent, a married couple, filed an appeal in the Family Court seeking divorce. Both parties subsequently reached an amicable settlement and submitted Consent Terms, which were recorded as Exhibit X. The court clarified that a decree of divorce will be granted once the respondent-wife receives the full agreed consideration. It further held that either party may apply for the divorce decree upon fulfilling the obligations in the Consent Terms, and any non‑compliance will constitute contempt of court. Consequently, the appeal and any interim applications were disposed of, and the parties agreed to withdraw all pending proceedings pending compliance.
