SMITA VIVEK BHURKAPALLE @ SWATI SONYABAPU CHAMEversusVIVEK RAMAKANT BHURKAPALLE
- Disposal
- DISPOSED OFF
Holding
A compromise voluntarily entered into by the parties and verified by the registrar is binding, allowing the court to pass a decree in its terms and dispose of the appeals.
Summary
The parties voluntarily entered into compromise terms which were submitted to the court for verification. The Registrar (Judicial) examined the terms and confirmed that they were voluntarily agreed upon and identified the counsel of each party. Based on this verification, the High Court accepted the compromise and ordered that a decree be drawn in accordance with its terms. Consequently, Family Court Appeal No.9 of 2026 was disposed of. The court further held that, with the disposal of Appeal No.9, no issues remained in Family Court Appeal No.8 of 2026, which was also disposed of.
Issues considered
- Whether a compromise voluntarily entered into by the parties and verified by the registrar is enforceable as a decree.
- Whether the disposal of one family court appeal extinguishes any pending relief in a related appeal.
