Disposal
DISPOSED OFF

Holding

The court accepted the parties’ voluntarily entered compromise, ordered a decree in its terms, and disposed both appeals.

Summary

The parties to two related family court appeals voluntarily entered into a compromise agreement, which was verified by the Judicial Registrar. The High Court examined the registrar’s report and found the compromise to be properly executed and identified by counsel. Consequently, the court accepted the consent terms and ordered a decree to be drawn in accordance with the compromise. The appeal numbered 9 of 2026 was therefore disposed. Since the disposition of appeal 9 extinguished any remaining issues, the earlier appeal numbered 8 of 2026 was also declared disposed. No further relief or orders remained pending.

Issues considered

  • Whether the compromise terms voluntarily entered into by the parties are valid and can be accepted by the court
  • Whether a decree can be drawn on the basis of the verified compromise
  • Effect of the disposal of one appeal on the related pending appeal
