Summary

The petitioner, Usha Narayan Utekar, filed an interim application seeking condonation of delay in setting aside an abatement and to bring the legal heirs of the deceased petitioner on record in Writ Petition No. 2541 of 2019 against Bharat Petroleum Corporation. The Court found no serious dispute and held that the cause of action survived against the heirs. Accordingly, the delay was condoned, the abatement was set aside, and leave was granted to amend the petition to include the heirs within one week. The Court also noted a prior order dated 18.06.2024 and 21.06.2024 where the petitioner’s counsel requested time to obtain instructions from the heirs regarding vacating premises, and the matter was listed for urgent hearing on 15.10.2026.
