The Court granted interim relief staying the execution proceedings until the appeal is disposed.

Summary

The appellant, Shalen D. Mello, filed an appeal (First Appeal No. 1989 of 2025) which was admitted by a coordinate bench of the Bombay High Court on 16 September 2025. Execution proceedings were simultaneously initiated before the Bombay City Civil Court against the respondents. The appellant sought interim relief to stay the execution pending determination of the appeal, arguing that there are triable issues. The Court, noting the admission of the appeal and the existence of arguable issues, granted the interim relief sought, staying the execution until the appeal is disposed. The interim application was consequently disposed, with no costs awarded, and the court directed the issuance of a fresh notice to the respondents and the appellant to furnish the appeal memorandum.
