Decided

Holding

The petition is dismissed and the interim application is disposed of as further adjudication is not required.

Summary

Alkyl Amines Chemicals Ltd. challenged a State Government order that rejected its application filed on 30 March 2016 under Section 5 of the Maharashtra Mathadi, Hamal and other Manual Workers Act, 1969, and granted no execution. The petition was pending before a Single Judge when the High Court heard it. The Court observed that the pending proceedings before the Single Judge were sufficient and further adjudication by the Court was unnecessary. Consequently, the petition was dismissed without costs, and the related interim application was also disposed of. All parties' contentions in the pending proceedings were left open for determination by the Single Judge.

Issues considered

  • What is the appropriate jurisdiction of the High Court to entertain the petition challenging the State Government's order under Section 5 of the Maharashtra Mathadi Act?
  • Should the High Court proceed with a full hearing when the petition is pending before a Single Judge?
  • Does the interim application survive after the dismissal of the main petition?
