The Court condoned the 81‑day delay, set aside the dismissal order, and restored the civil revision application subject to removal of office objections within three weeks.
Summary
Hinduja Layland Finance Ltd. filed an interim application seeking condonation of an 81‑day delay in filing the application and offered to remove the registrar's office objections within three weeks. The Registrar had earlier dismissed the application for non‑removal of those objections. The Court, after hearing counsel Alok D Mishra, accepted the explanation and set aside the dismissal order, restoring the civil revision application to the file. It conditioned the restoration on the applicant removing the objections within three weeks, after which the matter would be listed afresh. If the objections are not removed, the revision application will be dismissed and the order will stand recalled. The interim application was consequently disposed.
