Permission to travel abroad may be granted to a convicted appellant pending appeal, provided strict conditions are imposed.

Summary

The applicant, a 63‑year‑old senior citizen convicted under Section 506 of the Indian Penal Code, filed an interim application seeking permission to travel to the United States to care for her ailing daughter‑in‑law. The appeal against her conviction had been admitted by the High Court on 19 July 2011. The State opposed the application, urging that strict conditions be imposed if permission were granted. The Court, considering the humanitarian circumstances and the applicant’s age, allowed the travel but imposed conditions requiring the submission of itinerary, provision of contact details, a six‑month limit with no extensions, and a post‑return police report. The interim application was consequently disposed of with the order granting permission subject to these terms.
