The court directed Shivaji University to declare the examination results of the applicants.

Summary

The Bombay High Court, Kolhapur Bench, heard an interim application filed by Sanket Kumar Gawade and others seeking a declaration of their examination results for the March‑April 2026 exams, which had been withheld by Shivaji University. The petition also requested that colleges admit the applicants and accept their scholarship forms. The court noted that the same issue was pending before the Principal Seat and suggested administrative transfer for uniform adjudication. However, it limited its consideration to the prayer for declaration of results, finding no obstacle since the applicants were allowed to sit for the exams. The interim application was therefore allowed, directing Shivaji University to declare the results, subject to further orders and the final outcome of the main petition.

Issues considered

  • Whether the court can direct Shivaji University to declare the examination results of the applicants pending a final decision.
  • Whether interim relief can be granted in a writ petition pending transfer to the Principal Seat.

               1. This Court is informed that identical issue is pending before the

Principal Seat in a group of Petitions challenging the same Government

Circular. It would be appropriate if an administrative order is obtained

for transferring the present Petition to the Principal Seat, so that there

can be uniform adjudication of the issue.

Petition to the Principal Seat.

3. By the present Interim Application, the Applicants seek directions

to Respondent Nos. 2 to 4, Shivaji University, to declare the results of

the Applicants for the examinations held during March-April 2026, which

have been withheld, and for directions to the colleges to grant

admission to the Applicants and accept the scholarship forms.

4. Though, the Interim Application seeks number of reliefs, we are

inclined to only consider prayer clause (a) as regards the declaration of

the Applicant’s results. As the Petitioners were permitted to appear for

the examination, there can be no objection to the declaration of the

results.

5. Interim Application is allowed in terms of prayer clause (a) subject

to further orders and outcome of the Petition.

“(a). This Hon’ble Court be pleased to direct the Respondent No. 02 to 04
Shivaji University to Declare the Result of present applicants, Results of
Examinations which were held during March – April 2026.”
