AMITABH MUKUL BODHEversusHINDUSTAN UNILVER LTD

Decided
Disposal
DISPOSED OFF

Holding

The court disposed of the interim application, directing Respondent No.1 to issue the entitlement letter, complete e‑verification, and transmit the shares within three months, subject to satisfaction that no legal heir objects.

Summary

The petitioner, Amitabh Mukul Bodhe, filed an interim application in a testamentary petition seeking an entitlement letter and positive e‑verification from Hindustan Unilever Ltd. (Respondent No.1) to transfer shares of the deceased, Usha Janardhan Bodhe, into his name. Respondent No.1 agreed to issue the letter and complete e‑verification provided that the other legal heir, Dr. Ankoor Janardhan Bodhe, raised no objection. The petitioner submitted affidavits from all legal heirs, including Dr. Ankoor, confirming no objection. The court found no further issue in the interim application, disposed of it, and directed Respondent No.1 to complete the necessary steps within three months after being satisfied that all compliances, including the absence of objections, are met, and to transmit the shares to the petitioner. The order also noted that the shares are still with the company and not with the Investor Education and Protection Fund (IEPF).
