Holding

The court quashed and set aside the ex‑parte ad‑interim order, allowing the matter to be reheard.

Summary

The plaintiff Sandeep D. Gala and the defendant International Trading Co. were involved in Commercial IP Suit No.42729 of 2025. The plaintiff filed Interim Application No.1912 of 2026 under Order XXXIX Rules 3A and 4 read with Section 151 of the CPC seeking to vacate an ex‑parte ad‑interim order dated 21 January 2026 passed in Interim Application (L) No.42857 of 2025. Both parties consented to set aside the order and the court quashed it, directing that the matter be heard afresh. The court also allowed the defendant additional time to file an affidavit and the plaintiff a rejoinder, and stood over the proceedings to 10 September 2026. Consequently, the Court Receiver was ordered to return the goods to the defendant within a week and was discharged without accounting, with costs to be borne by the plaintiff.

Issues considered

  • Whether an ex‑parte ad‑interim order may be vacated on the parties' consent under the CPC.
  • Whether the court can set aside such an order and direct a fresh hearing.
  • What is the effect of setting aside the order on the appointment and duties of the Court Receiver.
