The Court condoned the delay as a sufficient cause, subject to the payment of costs to the respondents.
Summary
The applicants, Santosh Vilasrao Yadav and anr, filed an interim application seeking condonation of a 62‑day delay in filing a review under Order 47 of the Code of Civil Procedure, 1908, against an order dated 09‑06‑2025 in Civil Revision Application No. 322 of 2024. The respondents, Shailendra Vilasrao Yadav and others, opposed the condonation, arguing that the reasons given did not constitute sufficient cause. The Court examined the record and found no allegation of malafide or any advantage to the applicants from the delay. Relying on the Supreme Court’s pronouncement in Esha Bhattacharjee v. Raghunathpur Nafar Academy, the Court held that the cause shown was sufficient to merit condonation. Consequently, the interim application was allowed on the condition that the applicants pay Rs 15,000 to the respondents by 17‑09‑2026, failing which the application would be dismissed with higher costs. The review application will be registered only upon compliance with the cost payment condition.
