The application for early hearing filed by the informant is dismissed as no provision exists for such a request.
Summary
The applicant, an informant and victim, filed an interim application seeking an early hearing of the criminal appeal filed by the appellant against his conviction. The applicant argued that, as a victim examined before the trial court, he should be allowed expeditious consideration of the appeal. The respondent contended that there is no statutory provision permitting an informant to make such an application. The court noted that the appeal itself has been admitted and the appellant is presently on bail. In the absence of any legal provision authorising an informant to seek early hearing, the court dismissed the interim application.
