The court suspended the applicant's imprisonment sentence pending the final disposal of the revision application, subject to a personal bond.
Summary
The applicant, Ms Kanade Anand Udyog Pvt Ltd, filed an interim application seeking suspension of a short‑term imprisonment sentence and bail. The applicant had issued a cheque for Rs.1,04,00,000 and had deposited Rs.50,80,000, roughly 50% of the amount, and was already on bail during the trial. The State of Maharashtra objected, seeking rejection of the application and withdrawal of the deposited amount. The court, after hearing both sides, noted that the applicant had not misused liberty and that the revision application would take time. Accordingly, the court suspended the substantive sentence pending disposal of the revision application, subject to the applicant furnishing a personal bond of Rs.15,000 with sureties, and ordered the bail bonds to be filed before the Additional Sessions Judge. The interim application was thus disposed.
