The court stayed the imprisonment sentence and ordered the appellant’s release on bail subject to a personal bond and payment of the fine pending the appeal.

Summary

The High Court considered an interim application filed by Sandip Vishnu Hajgulkar, convicted under IPC section 376(2)(n) and POCSO sections 4, 8 and 12 for sexual offences against a 16‑year‑old girl. The applicant sought suspension of the imprisonment sentence and release on bail pending the disposal of Criminal Appeal No. 755 of 2025, contending that the relationship was consensual and the complaint was motivated by family objections. The trial court had upheld the conviction and imposed a fine, while the appellant argued he had complied with bail conditions during the trial. The bench observed that the appellant appeared to have a fair chance of success on the merits and that no breach of bail conditions was alleged. Consequently, the court stayed the sentence, ordered release on bail upon furnishing a personal bond of Rs 50,000 with sureties, and directed payment of the fine within four weeks. The interim application was disposed of by granting the relief.

Issues considered

  • Whether the sentence of imprisonment in a sexual offence case involving a minor can be stayed pending appeal
  • Whether bail can be granted to the convicted appellant during the pendency of the appeal
