Bombay High Court

AHMED MOHAMMED ALI QURESHIversusTHE STATE OF MAHARASHTRA AND ANR.

Decided

Holding

The Court held that the appeal must be listed for hearing at the earliest possible date.

Summary

The appellant, Ahmed Mohammad Ali Qureshi, filed an interim bail application after three prior bail applications were dismissed. The appellant argued that his appeal, which had been scheduled for hearing but not yet heard, should be taken up promptly as he is nearing the completion of a ten-year sentence on 23-08-2026. The Court noted the lack of relief in the earlier bail applications and considered the necessity of hearing the appeal itself. It held that the appeal should be listed for hearing at the earliest possible date. Consequently, the Court ordered that the appeal be listed for hearing on 15-09-2026 at 4:00 p.m.

                                                          DATE : 20th AUGUST, 2026
                       P.C. :

. Bail application filed on behalf of the appellant is listed today.
It is brought to our notice that three bail applications filed earlier by
this very applicant, were disposed of without any relief being granted
to the applicant. It is submitted on behalf of the applicant/appellant
that although this appeal was earlier fixed for hearing, it could not
be taken up for hearing and therefore, the present application has
been moved. It is further submitted that the applicant will be
completing period of incarceration of 10 years on 23.08.2026.

                       2. We are of the opinion that in the light of the applicant not
getting any relief in earlier three bail applications, it would be
appropriate that the appeal itself is taken up for hearing. In that
light, we are inclined to fix the hearing of this appeal at the earliest
                       possible.

                       3. List the appeal for hearing on 15.09.2026 at 04:00 p.m.
