Bombay High Court
MAHADEO SHANTARAM GHOLAPversusTHE STATE OF MAHARASHTRA
- Decided

The condition requiring the applicant to appear before the Sessions Court every three months is relaxed.
Summary
Mahadeo Shantaram Gholap was released on bail in 2014 with a condition to report to the Sessions Court, Greater Bombay, once every three months pending the decision of his appeal. The applicant, through counsel Ms. Meera Barge, argued that the quarterly reporting requirement was onerous. The Court examined whether the applicant had abused his liberty by seeking relaxation of the condition. Finding no abuse of liberty, the Court considered the long pendency of the appeal and the elapsed time since the original order. Consequently, the Court relaxed the condition of quarterly appearances. The interim application was disposed and the appeal was listed for final hearing on 26 November 2026.
Issues considered
- Whether the condition of quarterly reporting to the Sessions Court is appropriate given the pendency of the appeal
- Whether the applicant has abused his liberty by seeking relaxation of the bail condition
Subjects
- bail
- interim application
- condition of bail
- criminal appellate jurisdiction
