AVINASH NIVRUTTI BHOSALE S/O LATE NIVRITTI GANPATI BHOSALEversusDIRECTORATE OF ENFORCEMENT AND ANR

Decided
Disposal
Disposed Off

Holding

The court deleted both bail conditions 26(C) and 26(D), modifying the passport condition to a reporting requirement and imposing only an undertaking for advocate representation.

Summary

The applicant, Avinash Nivrutti Bhosale, filed an interim application seeking relaxation of two bail conditions imposed on 28‑08‑2026 in Bail Application No. 77 of 2024. Condition 26(C) required surrender of his passport, while condition 26(D) mandated his personal presence at trial hearings. Relying on earlier decisions of this Court, the judge held that the passport‑surrender condition was untenable and deleted it, substituting a requirement that the applicant report travel itineraries and provide contact details while abroad, with his passport to be returned upon certification of the order. Condition 26(D) was also deleted, subject to an undertaking that the applicant ensure his advocate’s presence at every trial hearing, with the trial court retaining discretion to order his personal appearance if needed. The interim application was therefore allowed and disposed.

Issues considered

  • Whether a bail condition requiring surrender of the applicant's passport is permissible under law.
  • Whether a bail condition mandating the applicant's personal presence at every trial hearing is permissible.
  • Whether the bail conditions can be modified in light of precedent and the applicant's rights.

3. Insofar as condition No. 26(C) is concerned, I prima facie do not

agree with the said condition considering several such orders passed

by this Court regarding the issue of surrendering passport. Said

condition stands immediately deleted.

4. The decisions of this Court in the cases of Mohammad Hanif

Nurani Vs. the State of Maharashtra and Anr. 1 and Kirti Vishwanath

Kedia Vs. Central Bureau of Investigation (EOB) and Anr. 2 squarely

cover the aforesaid request made by Applicant. I cannot take any

digressing view in the present matter and therefore the said condition

No.26(C) is deleted / cancelled and / or been scaled down to the

effect that whenever Applicant has to travel abroad he will report or

give the details of the itinerary, with detail address, with details of his
