VIKRAM BABASO SUTARversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
Disposed off as Withdrawn

Holding

The court condoned the 299‑day delay and allowed the filing of the criminal appeal.

Summary

The applicant, Vikram Babaso Sutar, filed an interim application seeking condonation of a 299‑day delay in filing a criminal appeal against a Special Judge's order dated 29 March 2025, which pertained to an offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The applicant's counsel argued that the delay was caused by the applicant's incarceration, a fact not contested by the respondents. The court, referencing its earlier decision in Hema Suresh Ahuja v. State of Maharashtra, allowed the application and condoned the delay. Consequently, the criminal appeal (ST) No. 1714 of 2026 was ordered to be registered. The High Court Legal Services Committee was directed to pay legal fees to the respondent’s counsel under the Legal Aid Scheme, and the interim application was disposed of.
