Bombay High Court

AJIT PARMARversusSTATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

The Court directs the trial court to dispose of the ‘C’ Summary Report by 28 February 2027, keeping the merits open.

Summary

The applicant, Ajit Parmar, filed an interim application seeking a court order directing the Additional Chief Judicial Magistrate to hear and finally decide a ‘C’ Summary Report submitted by the Economic Offences Wing, along with related proceedings, within a specified time. The Single Judge had earlier directed the trial court to decide the report at the earliest, but the report remained pending. The applicant argued that despite the earlier order dated 1 August 2025, the report had not been disposed of. The High Court considered whether it could issue a specific deadline for disposal of the report. The Court disposed of the interim application, directing the trial court to dispose of the ‘C’ Summary Report filed in Misc. Case No. Misc/4704469/2023 on or before 28 February 2027, while expressly keeping the merits of the case open for future determination.

Issues considered

  • Whether interim relief can be granted to enforce compliance with the earlier order of the Single Judge
