Bombay High Court

Sandip Pandurang AadhatraoversusSTATE OF MAHARASHTRA

Disposal
Disposed Off

Holding

The Court relaxed the bail condition restricting the applicant's entry into Pune and Solapur districts.

Summary

The applicant, Sandip Pandurang Aadhatrao, was granted bail in a case involving serious offences under the IPC, Arms Act, Maharashtra Police Act and MCOCA, with a condition that he not enter the districts of Pune and Solapur except to attend trial dates. After being elected as a Corporator of Pandharpur, the applicant sought relaxation of this restriction to enable him to perform his elected duties in Solapur. The respondent opposed the relaxation, arguing the condition should remain. The Court examined whether the bail condition was still necessary in view of the applicant's new public office and found no material justification for restraining him from Solapur, deeming the mention of Pune inadvertent. Consequently, the Court relaxed Condition C of the bail order and disposed of the interim application.

Issues considered

  • Whether the bail condition prohibiting the applicant from entering Pune and Solapur districts can be relaxed in view of his election as a Corporator.

seeking relaxation of bail conditions in connection with C.R. No.

2. While granting bail, vide order dated 13th June 2025, this
Court imposed, inter alia, a condition that:

"C] The applicant shall not enter into the limits of Districts
      - Pune and Solapur except to attend the dates before the
trial Court till conclusion of the trial".
3. Learned counsel for the applicant submitted that the
applicant had contested the election for the post of Corporator and
was elected. During the election period, the said condition was
relaxed for a period of 40 days. Now that the applicant has been
elected, it is necessary for him to enter District Solapur. He further
submitted that the mention of District Pune in the bail conditions
is inadvertent, as there is no material on record requiring the
applicant to be restrained from entering Pune.

4. Learned APP vehemently opposed the application and prayed
for its rejection.

5. As the applicant has been elected and is now a Corporator of
Pandharpur, Condition No. ‘C’ of the operative part of order dated
13th June 2025, restraining him from entering Districts Solapur
and Pune, is relaxed.

6. The interim application stands disposed of.

                                 (MRS. VRUSHALI V. JOSHI, J.)
