Bombay High Court

UMESH ARUN SAHANEversusSTATE OF MAHARASHTRA AND ANR.

Decided
Disposal
Disposed Off

Holding

The condition requiring weekly police‑station attendance is deleted, and the applicant need only attend when called by the investigating officer.

Summary

Umesh Arun Sahane filed an anticipatory bail application which was granted with condition No.7(b) requiring him to attend the police station every Sunday from 11 a.m. to 1 p.m. He later filed an interim application seeking relaxation of this condition, arguing that the investigation was complete, the chargesheet had been filed, and he had fully cooperated. The Court examined whether such a condition could remain after the investigation concluded. Finding no justification to retain the weekly attendance requirement, the Court deleted the condition, directing the applicant to appear only when called by the investigating officer. The interim application was therefore disposed, granting the requested relaxation.
