The petition may be restored provided the office objections are removed within four weeks.

Summary

Bright Outdoor Media Ltd filed an arbitration petition which was dismissed because it failed to remove office objections. The company applied for an interim order seeking restoration of the petition. The respondent opposed restoration but did not wish to file a reply affidavit. The Court, after considering the application, found sufficient cause to restore the petition in the interest of justice and allowed the interim application. It extended the time to remove the objections by four weeks, warning that failure to do so will result in the petition being rejected.

                    P.C.
                    1. Learned counsel for the Applicant seeks restoration of the captioned

Arbitration Petition which came to be dismissed for non-removal of office

                    objections.

                    2. Learned counsel appearing on behalf of the Respondent has opposed the

restoration but submits that he does not wish to file a reply affidavit.

                    3. Having perused the averments made in the Interim Application, I am

satisfied that there is sufficient cause shown to restore the Arbitration Petition. In

my view, the same would best be served in the substantive interest of justice.

                    4. Hence, the Interim Application is allowed in terms of prayer clause (a).

5. Time to remove office objections is extended by a period of four weeks

from today. It is clarified that in the event the objections are not removed, the

Petition would then stand rejected without further recourse.
