The Court held that an inadvertent statement of withdrawal does not amount to a voluntary withdrawal and the writ petition may be restored to the file.
Summary
The applicants filed Interim Application No.38645/2025 seeking restoration of Writ Petition No.285/2012 after an inadvertent statement was made in court on 22/2/2024 that the grievance did not survive due to limitation. The applicants argued that the statement was a mistake caused by confusion with other pending petitions and that they never intended to withdraw the writ. The Court examined whether such an inadvertent statement amounts to a voluntary withdrawal. Finding the reasons to be bona‑fide and no intention to withdraw, the Court ordered the writ petition to be restored to the file, subject to a cost deposit of Rs.10,000. The petition was listed for consideration on 13/10/2026 and the interim application was made absolute.

P.C:-
1 IA No.38645/2025 seeks restoration of the Writ Petition
to its file for its determination on merits. It is contended by the
learned counsel for the applicants that on 22/2/2024, an
inadvertent statement was made before the Court that the
grievance raised in the Writ Petition do not survive on account
of the passage of time.
2 According to the learned counsel for the applicants, this
was a sheer inadvertent error which according to her occurred
because there are several other petitions of the petitioner which
are pending and the instructions were assumed to be the one
given in the present Writ Petition.
