The court condoned the delay subject to the applicant paying Rs.5,000 costs to the respondent within two weeks.

Summary

The applicant, Reliance General Insurance Co., filed an interim application seeking restoration of its first appeal, which had been dismissed because it failed to serve notice on the respondents. The dismissal occurred after a delay of 1 year and 258 days. The court considered whether the delay could be condoned in the interest of justice. It held that the delay may be condoned provided the applicant pays costs of Rs.5,000 to Respondent No.1 within two weeks; otherwise the application would be dismissed. Upon payment of costs, the appeal will be registered and the applicant must serve Respondent No.2 within four weeks. The matter was adjourned to 5 February 2026.
