The court set aside the abatement, allowed the impleadment of the heirs, and condoned the delays in both applications.

Summary

In Suit No. 87 of 2026, the plaintiffs Hardik Ajmera & Ors. filed three interim applications seeking procedural reliefs. The first application (No. 4387) requested the court to set aside the abatement of the suit against Defendant No. 8 and to implead the legal heirs of that defendant, along with two additional flat purchasers. The court noted that service of notice had been effected and, in the absence of any opposition, condoned the 1,025‑day delay and ordered summons to be issued to the newly impleaded parties. The second application (No. 4396) sought condonation of a three‑day delay in filing the written statement of Defendant No. 9; the plaintiff’s counsel did not oppose, and the court allowed the condonation. The judge also directed that the interim applications be listed for further hearing by 24 September 2026. All reliefs were granted, allowing the suit to proceed against the newly added defendants.

Issues considered

  • Whether the abatement of the suit against Defendant No. 8 can be set aside and the legal heirs be impleaded
  • Whether a delay of 1,025 days in seeking to bring heirs on record can be condoned
  • Whether a three‑day delay in filing Defendant No. 9’s written statement can be condoned

Subjects

  • interim relief
  • abatement of suit
  • condonation of delay
  • impleadment of heirs
  • service of summons
  • civil procedure

setting aside the abatement of the Suit qua the Original
Defendant No. 8, Shri Sheth, and bringing on record the legal
heirs of Shri Sheth, i.e. proposed Defendant Nos. 1 to 3, as also
two other flat purchasers, i.e. proposed Defendant Nos. 4 and 5,
I am of the view that the Interim Application deserves to be
allowed.

forward to oppose the Interim Application, the same is allowed in
terms of prayer clause (a), which reads thus:

of 1025 days in filing the above Interim Application in so far
as it pertains to bringing on record the heirs of Defendant
