Holding
The Court reduced the bail surety amount to Rs. 15,000 and ordered the applicant to be enlarged on bail upon execution of the revised bond.
Summary
The applicant, Jamil Ahmed Ansari, sought modification of the bail conditions imposed on 17 July 2025, specifically requesting a reduction in the surety amount from Rs. 25,000 to a lower figure due to his inability to furnish the original surety for about eight months. The respondent State and the informant opposed the modification. The Court considered whether a bail condition could be altered on the ground of the bailer's financial incapacity. It held that the surety amount could be reduced to Rs. 15,000, subject to the trial court's satisfaction. The order to enlarge bail on the reduced surety was issued, and the interim application was disposed of accordingly.
