SAROJ RASIKLAL SALLAversusRESERVE BANK OF INDIA AND 6 ORS

- DISPOSED OFF

The court permitted the applicant to travel abroad subject to specific undertakings and suspended the Look Out Circular until 07/12/2026.
Summary
The applicant, Saroj Rasiklal Salla, sought leave to amend the dates of travel in her prayer clause and permission to travel to the United States for medical treatment from 26/09/2026 to 07/12/2026. The High Court granted leave to amend the prayer clause and entertained an additional affidavit containing a revised itinerary. The core issue was whether the court could suspend the Look Out Circular dated 31/05/2021 issued by Bank of Baroda and allow the applicant to travel abroad. The court held that the applicant may travel, subject to strict undertakings to adhere to the itinerary, return by the stipulated date, and not seek an extension. Accordingly, the Look Out Circular was suspended until 07/12/2026, and the interim application was disposed with the specified conditions.
Issues considered
- Whether the High Court can amend the prayer clause dates in the interim application.
- Whether the applicant may be permitted to travel abroad despite a Look Out Circular issued by a bank.
- What conditions, if any, should be imposed on the suspension of the Look Out Circular.
Subjects
- travel permission
- look out circular
- interim relief
- medical treatment
- suspension
- undertaking
- immigration
