Bombay High Court

SHAILESH MOHANLAL KARAVAversusSTATE OF MAHARASHTRA

Disposal
Allowed

Holding

The sentence shall stand suspended pending Criminal Appeal No.215 of 2026 and the applicant shall be released on bail upon furnishing a personal bond of Rs.15,000.

Summary

The applicant, Shailesh Mohanlal Karava, was convicted under IPC Sections 323, 353 and 506 and sentenced to six months, one month and one month of rigorous imprisonment respectively, to run concurrently, along with a fine of Rs.5,500. After conviction, he filed an application under Section 430(3) of the BNSS, 2023 seeking suspension of the sentence and release on bail, arguing that he had been on bail during the trial and had not violated any bail conditions. The Trial Court had initially stayed the sentence for 30 days, but the applicant sought a further extension pending his criminal appeal (Criminal Appeal No.215 of 2026). The High Court, after hearing counsel for both sides, found that the applicant had a good chance of success on the merits and that there were no allegations of bail violation. Consequently, the Court allowed the interim application, suspending the sentence pending the appeal and granting bail on a personal bond of Rs.15,000 with specific compliance conditions. The interim application was thereafter disposed of.

Issues considered

  • What is the appropriate procedure for suspending a sentence pending a criminal appeal?
  • Can bail be granted to a convicted person under Section 430(3) of the BNSS, 2023 when the bail conditions have not been violated?
  • Whether the applicant’s prior bail status and conduct justify the continuation of bail during the pendency of the appeal?
