MR. SURESH JAISING MOREversusMR SURESH PANDURANG JADHAV AND ORS.

Holding

The Court condoned the delay, set aside the dismissal order, and restored the civil revision application subject to removal of office objections within two weeks.

Summary

Suresh Jaising More filed a Civil Revision Application (ST) No. 9136 of 2026 which was dismissed on 4 May 2026 for failure to remove office objections. He subsequently filed Interim Application No. 6288 of 2026 seeking condonation of the delay in raising the matter. The Court, considering the need to advance substantive justice, condoned the delay, set aside the dismissal order, and restored the revision application on the condition that the applicant remove the office objections within two weeks. If the objections are removed, the revision will be listed as a fresh matter; if not, the order will be recalled and the revision dismissed. The interim application was therefore disposed with the above directions.

Issues considered

  • Whether the delay in filing the interim application can be condoned
  • Whether an order dismissing a civil revision for non‑removal of office objections can be set aside
  • Whether the civil revision can be restored subject to compliance with procedural objections
