Temporary bail was granted on humanitarian grounds with stringent conditions.

Summary

The applicant, convicted under the POCSO Act in Special Case No. 300/2020, sought temporary bail to attend his mother's funeral and perform customary rituals. The applicant's counsel argued that humanitarian considerations warranted a 13‑day bail, while the prosecution, acknowledging the applicant's right to perform last rites, did not oppose the request but sought stringent conditions. The court examined the balance between the seriousness of the offences and the compassionate grounds presented, noting the applicant's willingness to surrender and comply with strict bail terms. Relying on the principle that bail may be granted on humanitarian grounds even for serious offences, the court ordered temporary bail with specific conditions, including a PR bond, movement restrictions, and mandatory surrender. The order was made pending the final disposal of Criminal Appeal No. 18 of 2026.

Issues considered

  • Whether temporary bail can be granted to a convicted POCSO offender on humanitarian grounds to attend a family funeral.
  • Whether imposing strict conditions suffices to mitigate the risk posed by the applicant's release.
