RAHUL MANUBAPU SHELKEversusSHIRUR SHIKSHAN PRASARAK MANDAL THR ITS PRESIDENT AND ORS

Decided
Disposal
Disposed Off

Holding

The order dismissing the writ petition for non‑removal of office objections is set aside and the petition is restored to the file.

Summary

The petitioner, Rahul Manubapu Shelke, filed a writ petition which was dismissed on 19 June 2026 for failure to remove office objections. The petitioner subsequently filed an interim application asserting that all office objections had been removed. The learned counsel for the petitioner submitted evidence of the removal, and the court considered whether the dismissal order should stand. The court held that the earlier dismissal was improper in view of the removal of objections and set aside the order. Consequently, the writ petition was restored to the file and scheduled for fresh hearing on 7 September 2026. The interim application was thereafter disposed.
