Holding

The appeal is permitted to be withdrawn and the matter disposed.

Summary

The appellant, Ankit Arun Sharma, sought to withdraw his appeal against a Family Court order directing the return of streedhan articles listed in ‘A’. He argued that compliance with the direction had already been ensured. The court noted that any question of actual compliance would be decided in pending execution proceedings. Consequently, the court allowed the withdrawal of the appeal and disposed of the pending interim applications. The matter was thus concluded without further adjudication on compliance.

Issues considered

  • Whether the appellant may withdraw the appeal pending execution of the Family Court's direction
  • Whether compliance with Direction No.3 needs to be established before allowing withdrawal
