PRAMOD B GALINDEversusTHE STATE OF MAHARASHTRA THROU. SEC SOCIAL JUSTICE AND SPECIAL ASSISTANCE AND ORS

Decided

Holding

The Court set aside the Registrar’s order and restored the writ petition, subject to removal of all office objections within two weeks.

Summary

The petitioner, Pramod B. Galinde, filed an interim application seeking condonation of a 65‑day delay in filing a request to remove office objections that had led the Registrar to refuse registration of his writ petition. The petitioner argued that the objections could not be removed within the originally prescribed period but was ready to do so if the Court granted additional time. The respondents objected, but the Court found the explanation satisfactory and accepted that sufficient cause was shown for condoning the delay. Consequently, the Court set aside the Registrar’s order dated 17 September 2025 and restored the writ petition to the Court’s file. The petition was ordered to be reinstated on the condition that all office objections be removed within two weeks, failing which the petition would be dismissed. The interim application was therefore disposed in favour of the petitioner.

Issues considered

  • Whether the 65‑day delay in filing the interim application for condonation of delay in removing office objections can be condoned.

                                           DATE : 16th SEPTEMBER, 2026.

                              P.C.:
                              1. Heard learned counsel appearing for the Applicant/Petitioner

and learned counsel appearing for the Respondents.

                              2. This Interim Application has been preferred against the order

dated 17th September 2025 passed by the Registrar (Judicial-I) of

this Court in Writ Petition (L) No. 25936 of 2025, whereby

registration of the above numbered Writ Petition was directed to be

refused on account of non-removal of office objections within the

                              prescribed period.

                                                                 1
                                                        6-IA-7280-2026 (C).doc

3. Mr. Ingule, learned Counsel appearing for the

Applicant/Petitioner submits that the office objections could not be

removed within the time granted and seeks an opportunity to

remove the same. It is submitted that the Petitioner is ready and

willing to remove the office objections within the time that may be

granted by this Court.

4. Mr. Ingule, learned Counsel appearing for the

Applicant/Petitioner, has drawn the attention of the Court to the

averments made in the Interim Application, particularly paragraphs

7 and 8 thereof, in support of the reasons for non-removal of the

office objections within the prescribed period. There is also a delay

of 65 days in filing the present Interim Application.

5. Ms. Neha Bhide, learned counsel appearing for Respondents

has objected to this Interim Application. However, considering the

explanation tendered, we are satisfied that sufficient cause has

been shown for condonation of the delay. The explanation set out in

paragraphs 7 and 8 of the Interim Application for the non-removal

of the office objections is also found to be satisfactory in the given

facts and circumstances.

6. In light of the above and in the interest of justice, the order

dated 17th September 2025 passed by the Registrar (Judicial – I) of

this Court is hereby set aside.

                                   2

7. Accordingly, the Writ Petition would be restored to the file of

this Court, subject to the removal of all office objections by the

Petitioner within a period of two weeks from today.

8. It is made clear that in the event the office objections are not

removed within the period afore-mentioned, the Writ Petition shall

stand dismissed, without any further reference to the Court.

9. The Interim Application is Disposed Of in the above terms.
