The court held that the matter must be decided by the Pune Municipal Corporation after receipt of records from PMRDA, and no adverse order, including demolition, shall be passed without a hearing of the affected parties.

Summary

The petitioners filed a writ petition seeking a mandamus directing the respondents to demolish unauthorised structures on Survey Nos.5/1 and 4/5 in Kondhwe Dhawde, Pune. Respondent No.1 (PMRDA) argued that the land now falls under the jurisdiction of Respondent No.3 (Pune Municipal Corporation) and that record transfer would take about 15 days. Respondent No.3 indicated it would consider the petitioners' representation only after receiving the transferred records. The court directed Respondent No.3 to decide the petitioners' representation within eight weeks of receipt of the records and to hold a hearing, including the intervenor, before passing any adverse order. The parties were scheduled to appear before the corporation on 27 October 2026, after which a hearing date would be fixed. Both the writ petition and the interim application were subsequently disposed of without any demolition order being issued.

Issues considered

  • Whether the court can issue a mandamus directing demolition of unauthorised structures pending jurisdictional transfer.
  • Whether the jurisdiction to act on the unauthorised structures lies with PMRDA or Pune Municipal Corporation.
  • Whether the petitioners are entitled to an order for demolition without a hearing.
  • Whether the corporation must wait for record transfer before adjudicating the grievance.
