Holding

The Court allowed the interim application, condoned the delay, and restored the writ petition to the file.

Summary

Kishor Shrimant Suryawanshi filed Writ Petition (ST.) No. 13345 of 2026 which was dismissed because office objections were not removed. He subsequently filed Interim Application No. 7665 of 2026, thirty days after the dismissal, seeking restoration of the writ petition. The Court examined the reasons for the delay, found them satisfactory, and consequently condoned the delay. In the interest of justice, the Court ordered that the writ petition be restored to the file and that the office objections be removed. The interim application was therefore allowed.

Issues considered

  • Whether a delay of thirty days in filing an interim application for restoration of a dismissed writ petition can be condoned.
  • Whether the writ petition can be restored to the court’s file after condonation of delay.

  • interim application

                        1. By this Interim Application, the applicant/petitioner is praying for

objections. There is a delay of 30 days in filing this Interim Application.

                        2. We have perused the averments as made in the Interim application. Delay

caused in filing this application has been appropriately and sufficiently explained,

hence the same is condoned. It is hence in the interest of justice that the Writ

Petition is restored to the file of this Court.

                        3. Accordingly, Interim Application is allowed. The Writ Petition is restored to

the file of this Court. Office objections be removed.

                        (DR. NEELA GOKHALE, J.) (G. S. KULKARNI, J.)
