Summary

The Principal Commissioner of Income Tax appealed against Firmenich Aromatics Production (India) Pvt. Ltd. concerning a tax liability of Rs.1,83,78,344 for assessment year 2017-18. The appellant relied on Circular No.9/2024 issued by the CBDT, which indicated that proceedings were unnecessary in such circumstances. The High Court considered the tax effect and the guidance in the circular and permitted the withdrawal of the appeal. Consequently, the appeal was allowed to be withdrawn, the interim application was dismissed, no costs were awarded, and court fees were to be refunded. The Court expressly kept the questions of law open for future reference.
