Bombay High Court
ASHOK MAHADEO SAWANTversusSATYAM ATUL SURANA AND ORS
- Decided
- Disposal
- Disposed Off
Holding
The Court held that the respondents must file an additional affidavit on progress, release the deposited compensation without impediment, and provide victim details to the State Government, thereby disposing the interim application.
Summary
The petitioner, Mr. Satyam Atul Surana, filed a public‑interest litigation seeking compliance with a Maharashtra State Human Rights Commission order directing payment of compensation to victims. The State of Maharashtra and other respondents were directed to publish notices and furnish detailed information about the victims, but the petitioner alleged that the respondents had not fully complied. The Court noted that an affidavit of compliance had been filed, but ordered the Home Department to file an additional affidavit showing progress made since the earlier filing. The Court also directed the Registry to release Rs. 5 lakhs of compensation already deposited, subject to no further impediment, and instructed the Human Rights Commission to provide victim details to the State Government. The interim application (No. 7794 of 2026) was consequently disposed, with the matter listed for further hearing on 25 November 2026.
Issues considered
- Whether the respondents have complied with the Court’s earlier order to publish public notices and furnish victim details.
- Whether the compensation amount deposited with the Court’s Registry should be released to the victims as per the Human Rights Commission order.
- Whether the Home Department must file an additional affidavit indicating further progress.

Deputy Secretary, Home Department i.e. Respondent No.2 is
already on record, indicating that certain steps have been
taken in response to the mandate of this Court. The Home
Department has undertaken publication of public notices in
widely circulated newspapers i.e. “Lokmat” (Marathi daily) on
30th April, 2026, “Navbharat” (Hindi daily) on 1 st May, 2026
and “The Times of India” (English daily) on 30 th April, 2026 and

the learned Counsel for the Petitioner submits that at the time
of instituting the present Petition, total 136 exemplars were
cited. Subsequently, there might be some additions.
2. The learned Counsel for the Petitioner further
submitted that until date, the answering Respondent has not
furnished entire details, which shows that the Respondents
are lacking in bona fides in disbursement of the
award/compensation in the light of Orders passed by the
Maharashtra State Human Rights Commission.
3. We find that even though in response to the earlier
Order dated 27th January, 2026, the affidavit of compliance is
already on record, we further direct to the Respondent No.2 to
file an Additional Affidavit indicating therein since filing of the

previous affidavit, what progress has been made. Accordingly,
learned AGP is accorded four weeks’ time to do the needful.
4. List this matter again on 25th November, 2026.

Application, in support of his Interim Application submits that
in response to the earlier Order dated 27 th January, 2026, the
compensation amount of Rs. 5 lakhs has been deposited with
the Registry of this Court. The learned Additional Government
Pleader fairly submits that he has no objection to release of the
compensation amount in terms of the Order passed by the
State Human Rights Commission on 19th September, 2019.
6. Accordingly, direction is issued to the Registry to
release the amount forthwith in terms of said Order dated 19 th
September, 2019 (Supra), in case there is no other
impediment. The learned Counsel for the Applicant submits
that in response to the previous Order passed by this Court,
the entire details in this regard, have been furnished to the

within ten days from today.
