Holding

The interim application is allowed; the earlier order is recalled and the writ petition restored subject to removal of objections within ten days.

Summary

The High Court considered an interim application filed by Adani Electricity Mumbai Limited seeking relief from procedural objections raised by the Registry in Writ Petition No. 8480 of 2026. The applicant argued that unavoidable circumstances prevented timely rectification of the objections and requested a two‑week period to cure the defects. The respondents did not oppose the request. The Court allowed the interim application, recalled its earlier order dated 21 August 2026, and restored the writ petition to its original file, directing the applicant to remove all office objections within ten days of the order’s upload and to list the petition for hearing on 21 October 2026.

Issues considered

  • Whether the Court should grant an extension to the petitioner to rectify procedural objections raised by the Registry
  • Whether the earlier order dated 21 August 2026 should be recalled and the writ petition restored

  • interim relief
  • procedural defects
