Holding
The interim application was disposed of as nothing survived; prayers (a) and (c) were held infructuous and prayer (b) was stayed pending the Applicant’s affidavit of charges.
Summary
The High Court examined an interim application filed by Axis Trustees Services Ltd seeking (a) production of documents by Novelty Power & Infratec Ltd concerning ownership of the 4th floor of Elder House, (b) hand‑over of possession of that floor to the Official Liquidator, and (c) appointment of a valuer and payment of valuation fees. The Official Liquidator contended that (a) and (c) were moot because the assets were no longer in use, a view the Court accepted. While the Court entertained prayer (b), it conditioned any order on the Applicant furnishing affidavits of the charges, costs and expenses it claims, within two weeks, after which the Official Liquidator would consider the matter. As no substantive relief remained, the Court disposed of the application. The Court also extended the time for filing a rejoinder by two weeks.
Issues considered
- Whether the Court should order Novelty Power & Infratec Ltd to produce documents relating to ownership of the 4th floor of Elder House.
- Whether the Court should direct the noticee to hand over physical possession of the 4th floor to the Official Liquidator.
- Whether the Court should permit the Official Liquidator to appoint a valuer and pay valuation fees from the liquidation fund.
- Whether the Applicant must submit affidavits evidencing the charges, costs and expenses it claims.
