Holding

The two‑day delay is condoned and the writ petition is restored, subject to removal of office objections within a week.

Summary

Universal Sompo General Insurance Co. Ltd filed an interim application seeking condonation of a two‑day delay in filing a restoration application for its writ petition (ST) No. 30729 of 2025, which had been dismissed for failure to remove office objections. The Court examined whether such a short delay could be excused in the interest of substantive justice. It held that the delay was condonable and set aside the dismissal order, thereby restoring the writ petition to file. The Court conditioned the restoration on the petitioner removing the office objections within one week, after which the petition will be listed for admission on 1 September 2026. If the objections are not removed within the stipulated period, the restoration order will be recalled and the petition dismissed. The interim application was consequently disposed.
