The court, by consent, declined to transfer the petition and ordered the respondent to pay Rs.1,500 as conveyance charges to the applicant for each hearing.

Summary

The applicant, a wife, filed a Miscellaneous Civil Application under Section 24 of the Code of Civil Procedure seeking transfer of a family court petition from Sangli to the Senior Division Civil Court in Kolhapur, citing inability to bear conveyance costs. The respondent agreed to bear those costs and offered to pay the applicant Rs.1,500 per hearing for travel and refreshments. Both parties consented to this arrangement, and the applicant accepted the respondent's statement. The court, by consent, disposed of the application, ordering the respondent to pay the stipulated amount for each hearing. No transfer of the petition was ordered, and the matter was resolved through the parties' agreement.

Issues considered

  • Whether the application for transfer of the family court petition under Section 24 CPC should be granted on the ground of the applicant's inability to bear conveyance expenses
  • Whether the parties' agreement for the respondent to pay conveyance charges can be accepted by the court in lieu of transfer
